General Terms and Conditions of Sale

These terms and conditions of sale are entered into on the one hand by the company Bohemian Chic Interior with a share capital of €2000 whose registered office is located at 161 rue de la croix de portier 38650 SINARD, registered with the Grenoble Trade and Companies Register under number 821 621 588, hereinafter referred to as Bohemian Chic Interior and managing the website www.bohemianchicinterior.fr and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.bohemianchicinterior.fr, hereinafter referred to as "the buyer".

Article 1. Purpose

These terms and conditions of sale aim to define the contractual relationship between Bohemian Chic Interior and the buyer, and the conditions applicable to any purchase made through the website www.bohemianchicinterior.fr. Purchasing a product through this website implies the buyer's unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares, firstly, that the purchase of products on the website www.bohemianchicinterior.fr is unrelated to their professional activity and is limited to strictly personal use, and secondly, that they have full legal capacity to enter into this agreement under these terms and conditions of sale.

Article 2. Products

Bohemian Chic Interior reserves the right to modify its product range at any time. Each product is presented on the website with a description outlining its main technical characteristics. Article 3. Prices

The prices shown on the product pages of the online catalog are in Euros (€), inclusive of all taxes (VAT included), based on the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Bohemian Chic Interior reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased, according to the total amount of the order. In mainland France, shipping is free.

Article 4. Ordering and payment terms

Before placing any order, the buyer must create an account on the website ......................... (website name, URL). The account creation section is accessible directly from the sidebar menu. Each time the buyer visits the site, if they wish to place an order or view their account (order status, profile, etc.), they will need to log in using their credentials. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by check." This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order confirmation email. To finalize payment and initiate order processing, the buyer must print this order confirmation email and send it, along with a check made payable to "Bohemian Chic Interior," to the following address: 161 rue de la croix de portier 38650 SINARD, France. No cash payments should be sent. Only checks drawn on a French bank will be accepted. Upon receipt of the check, the order will be processed and the buyer will be notified by email. Bohemian Chic Interior will ship the products no sooner than two business days after the check corresponding to the order has cleared, subject to availability.

- Payment by bank transfer: The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by bank transfer." Finally, the last step allows the buyer to review all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon confirmation, the buyer receives an order confirmation email. To finalize payment and initiate order processing, the buyer must contact their bank to transfer the corresponding amount to the Bohemian Chic Interior bank account, the details of which are provided to the buyer. Upon receipt of payment, the order will be processed and the buyer will be notified by email. Bohemian Chic Interior will ship the products no sooner than two business days after receiving payment for the order, subject to availability.

- Secure payment via PayPal or credit card (through the PayPal system): The buyer selects the products they wish to order and adds them to their "shopping cart," modifies the order if necessary (quantities, product codes, etc.), and verifies the delivery address or enters a new one. Shipping costs are then calculated and displayed to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment via PayPal." The following step allows them to review all the information, read and accept these terms and conditions by checking the corresponding box, and then confirm their order by clicking the "Confirm my order" button. Finally, the buyer is redirected to the secure PayPal interface to safely enter their PayPal account or credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment via PayPal or credit card is irrevocable. In the event of fraudulent use of the card, the buyer may request cancellation of the card payment; the sums paid will then be credited back or refunded. The cardholder is not liable if the disputed payment is proven to have been made fraudulently, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges incurred, the cardholder must dispute the charge in writing with their bank within 70 days of the transaction, or 120 days if their contract with the bank stipulates this extension. The debited amounts are refunded by the bank within a maximum of one month after receipt of the cardholder's written dispute. The cardholder will not be charged any fees for the refund.

Order confirmation implies acceptance of these terms and conditions of sale, acknowledgement of having read and understood them fully, and waiver of any conflicting terms and conditions of purchase. All data provided and the recorded confirmation will serve as proof of the transaction. If the buyer has an email address and has provided it on the order form, Bohemian Chic Interior will send an email confirming the order registration.

Article 5. Retention of Title

Bohemian Chic Interior retains full ownership of the products sold until full payment of the price, including principal, fees and taxes.

Article 6. Right of withdrawal

In accordance with the provisions of article Article L.221-18 of the Consumer Code stipulates that the consumer has a period of fourteen (14) calendar days from the receipt of the goods by himself or by a third party designated by him, other than the carrier, to exercise his right of withdrawal without having to justify his decision.

To exercise this right, the consumer must notify the seller of their decision to withdraw by a an unambiguous statement (for example by email or post), before the expiry of the withdrawal period.

In the event of exercising the right of withdrawal, the seller shall reimburse the consumer for all sums paid, including delivery costs, without undue delay and at the latest within fourteen (14) days from the date on which he is informed of the consumer's decision to withdraw.

The seller may defer the refund until the goods are recovered or until the consumer has provided proof of shipment of the goods, whichever occurs first.

The refund is made using the same payment method used by the consumer during the initial transaction, unless the consumer expressly agrees to the use of another payment method.

The costs of returning the goods remain the responsibility of the consumer.

The right of withdrawal does not apply to the exceptions provided for in Article L.221-28 of the Consumer Code.

Article 7. Delivery

The products are delivered to the address indicated by the customer when ordering, within the geographical area covered by the delivery methods offered.

Delivery times are communicated to the customer before order confirmation.

In the event of a delivery delay, the customer may request the seller to complete the delivery within a reasonable additional period. If delivery does not occur within this period, the customer may cancel the order in writing. The order will then be refunded in accordance with applicable regulations.

Bohemian Chic Interior will communicate the tracking number of their package to the customer by email when it is available.

The transfer of risk of loss or damage to the products occurs when the customer, or a third party designated by them, takes physical possession of the products.

Upon receiving the order, the customer is asked to check the condition of the package and the delivered products. If any issues are found (damaged package, missing or damaged product), the customer is asked to contact the seller as soon as possible so that a suitable solution can be offered.

Article 8. Legal Guarantees

The consumer benefits from the legal guarantees provided by law, independently of any commercial guarantee that may be granted.

Legal guarantee of conformity
In accordance with Articles L.217-3 et seq. of the Consumer Code, the consumer has a period of two years from the delivery of the goods to invoke the legal guarantee of conformity.

The goods are compliant if they are fit for the purpose usually expected of similar goods, if they correspond to the description given by the seller and if they have the advertised qualities.

In the event of a lack of conformity, the consumer may request repair or replacement of the goods. If these solutions are impossible or disproportionate, they may request a full or partial refund .

Legal guarantee against hidden defects
In accordance with Articles 1641 et seq. of the Civil Code, the consumer may also invoke the guarantee against hidden defects, within a period of two years from the discovery of the defect .

In this case, the consumer can choose between rescinding the sale or a price reduction , in accordance with Article 1644 of the Civil Code.

Bohemian Chic Interior, in the context of distance selling, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the internet, such as data loss, intrusion, viruses, service interruptions, or other unintentional problems.

Article 12. Consumer Mediation
